There has been a lot of publicity in local press regarding the significant changes made to the legal aid system on the 1st April 2013. It is now a commonly mis-held belief that legal aid is no longer available for family cases such as divorce, financial matters and applications concerning children. This is not strictly true.

Legal Aid is available for cases where a child has been taken in to care; is subject of a child protection plan; where a person seeks to protect a child from abuse and for people who have suffered domestic abuse. In the above circumstances legal aid may also be available for any associated family case such as divorce.
Evidence must be provided to support the risk of abuse or violence.  This can be obtained from the police, health visitors, social workers GP, domestic violence organisation, refuge etc. The definition of domestic violence is any incident or pattern of incidents of controlling coercive or threatening behaviour, violence or abuse between individuals who are associated with each other.
